A WILL

Do you have an up-to-date Will?

The importance of having an up to date and valid Will cannot be understated and is a crucial document everyone needs to have in place. A Will allows you to communicate your wishes clearly and precisely and lets you tell the world whom you want to get your assets. It is a simple process that can save your family grief, time and money, as well as give you peace of mind. What happens if you pass away without a valid Will? You are deemed to have passed away ‘intestate’. This means your estate is to be distributed to your closest next of kin starting with your spouse, children and/or grandchildren. This can be a lengthy and stressful process for all involved.

AN ENDURING POWER OF ATTORNEY

This is a formal document giving another person the authority to make decisions on your behalf.

Why is it important to have an Enduring Power ofAttorney?

Allows you to choose someone you trust to make decisions for you when you are unable to do so.

What can decisions can your Attorney make for you?

Your attorney can provide direction for your care, including making medical, financial and personal decisions. An Attorney can help to safeguard your assets.

When does an Enduring Power of Attorney take effect?

This is your decision – you can make it immediate, upon a medical certificate from your Doctor stating you need assistance or if you give instructions in writing.

What happens if you don’t have an Enduring Power ofAttorney?

A Tribunal or the Courts may appoint someone unknown to you to administer your affairs.

WHAT IS PROBATE?

Probate is the official recognition that a Will is legally valid by the Supreme Court in the jurisdiction where the Estate assets were held.
A grant of probate is a Supreme Court document that recognises someone’s authority to deal with the estate of a person who has passed away. Probate is often needed before the Executor of a deceased estate can take control of the estate’s assets (administer the estate).

WHERE TO START

Before your appointment to
see our team to have a legal
will drafted, you may wish to
consider the following issues:

  • The full names of your beneficiaries, executors and trustees;
  • What percentage of your estate each beneficiary is to receive;
  • The extent of your assets held jointly or solely, including details of a Family Business/Company operated by you;
  • Details of your Superannuation;
  • If you intend to exclude any potential member of your direct family you should be prepared to discuss this with us at your first meeting;
  • Should you consider the creation of a Testamentary Trust? This legal tool may protect your estate from challenges by persons who may have an interest in your estate as creditor or otherwise. A Testamentary Trust can also be an effective tax planning tool. A Letter of Direction can assist your trustees to guide them with your thoughts and wishes after your death.
